Foreign citizenship should be considered an aggravating circumstance when committing a crime — a corresponding draft amendment to the Criminal Code of the Russian Federation has been submitted to the State Duma. Its author believes that the norm will become a “preventive mechanism” and will contribute to more responsible behavior of foreigners in the Russian Federation. Lawyers and experts interviewed by Kommersant believe that the amendments contradict the constitutional principle of equality before the law and may contribute to the outflow of migrants.
The draft amendments to Part 1 of Article 63 of the Criminal Code of the Russian Federation (“Circumstances aggravating punishment”) were submitted to the State Duma by deputy Yevgeny Marchenko (non-factional parliamentarian). He proposes to consider the commission of a crime by “a person with foreign citizenship or a stateless person” as an aggravating circumstance. Currently, Part 1 of Article 63 of the Criminal Code of the Russian Federation contains a list of two dozen aggravating circumstances, including recidivism, crimes of revenge, with a weapon in hand or in a police uniform.
Adding foreign citizenship to the list, according to the deputy, "will become an effective preventive mechanism" and will contribute to "more responsible behavior" of foreigners in the Russian Federation.
In particular, Mr. Marchenko refers to statistics from the Investigative Committee of the Russian Federation, which indicate a 55% increase in the number of extremist crimes committed by migrants in the first half of 2024.
The State Duma is currently considering several bills that tighten migration policy, for example, equating the organization of illegal migration to especially serious crimes, and illegal stay in the country to aggravating circumstances when sentencing. State Duma Speaker Vyacheslav Volodin called tightening control over migration a priority for the State Duma in this session. On October 1, the State Duma adopted in the second reading a bill that establishes a three-year period of residence in marriage, mandatory for obtaining a temporary residence permit. Deputy Interior Minister Alexander Gorovoy told Kommersant that the authorities are preparing a register of foreigners illegally staying in the Russian Federation.
According to Anna Golub, a partner at the Criminal Defense Firm, the bill violates the principle of Article 19 of the Russian Constitution on equality before the law regardless of gender, nationality or race. Vladislav Gubko, a lawyer at the Tomashevskaya & Partners law firm, reminds us that the principle of equality before the law and the court is also enshrined in Article 4 of the Criminal Code of the Russian Federation. In his opinion, the introduction of new aggravating factors into the Criminal Code of the Russian Federation “must be due to an increase in public danger,” and in the case of the bill, this is explained only by the “inadmissibility of unlawful behavior by persons staying in the country as guests.”
Vladislav Shalaginov, a lawyer at the Minushkina & Partners law firm, believes that the adoption of the amendments will lead to the imposition of “more severe punishments” on foreigners who have committed a crime and, as a result, will increase the likelihood of decisions to ban entry and make it undesirable to stay in the Russian Federation.
"This will lead to an outflow of people arriving in our country for work, tourism and other purposes," Anna Golub suggests. The lawyer also does not understand what to do for people with dual citizenship, who, when "the norm is read literally, are automatically 'awarded' an aggravating circumstance." Evgeny Varshaver, head of the Migration and Ethnicity Research Group at RANEPA, calls the bill "a link in the path to establishing a special legal regime that does not welcome foreigners in the Russian Federation." In his opinion, the current Criminal Code of the Russian Federation is sufficient to prevent Russian citizens and foreigners from committing crimes. "It is unlikely that this norm can significantly change the behavior of foreigners. But the fact that they will be 'on special terms' in Russia may well become a factor taken into account when considering the possibility of labor migration - primarily by skilled and highly skilled migrants," he believes.

Serbian leader Aleksandar Vucic decided not to congratulate Russian President Vladimir Putin on his birthday. This is reported by the Danas publication.
In Belgrade, no specific reasons were given for the lack of congratulations from the authorities on Vucic's part, the article says.
The article cites the words of popular Serbian lawyer Nikola Lakic, who said that Vucic congratulated Putin on his birthday every year during his eight years in the presidential chair. But this year there were no congratulations.
According to Lakic, Vucic used to be in close contact with Putin, but now only with French President Emmanuel Macron, as this has become beneficial for the Serbian leader.
