^Tuossa on varmaan järkeä, kyllähän tuommoinen piipun massa töyssyissä pyrkii liikehtimään omiaan.
Tykin osia on muunmuassa lukko eli tuliaseen perän sulkulaite, putki joka on tuliaseen piippu, jonka kaliiperi on yli 20 mm.
Aikaisemmin on mainittu, että tuo putki takana on "lepuutus asento", eli putki lepää jonkin tuen päällä, eikä ole suuntauskoneiston varassa, jolloin suuntauskoneisto ei kulu putken heiluessa jokaisesta töyssystä. Toiset ovat maininneet muitakin syitä ja ne voivat olla ihan yhtä valideja kuin minunkin.

Subject: Petition No 0177/201 by Jürgen Rahf (Finnish), on the Finnish Government’s
violation of EU legislation
1. Summary of petition
The petitioner states that the Finnish Government violated the provisions of Directive
2009/81/EC on the coordination of procedures for the award of certain works contracts,
supply contracts and service contracts by contracting authorities or entities in the fields of
defence and security when it purchased 100 used Leopard tanks from the Dutch army. This
purchase involved an amount of approximately EUR 200 million. The petitioner states that
the purchase of military material of this kind must be put out to public tender. The Finnish
Government neglected to do so, however, when purchasing these tanks. The petitioner has
asked the Finnish ministry for information on this issue but has not received an answer. He
believes that a public tender could easily have been invited, since tanks of this type were
available in various EU Member States. The petitioner is an arms dealer and has also sold
Leopard tanks himself. He is demanding an investigation.

Rule 216(6).
3. Commission reply, received on 29 September 2015
The Commission's observations
Public contracts awarded by a government to another government relating to the supply of
military equipment or sensitive equipment and works and services directly linked to such
equipment are, in principle, excluded from the scope of application of Directive 2009/81/EC.
According to Article 11 of this Directive, none of the exclusions laid down therein may be

used for the purpose of circumventing its provisions. In general, Member States should be
able to establish that a decision to award a contract to another government is the best solution
to fulfil its procurement requirements. The Commission has no sufficient information to
establish whether the contract for supply of 100 Leopard 2A6 tanks from the Dutch
government to the Finnish Government has been correctly excluded from the scope of
application of Directive 2009/81/EC.
Conclusion
The Commission will take contact with the Finnish authorities to ask for some clarifications
on the contract award at issue.
4. Commission reply (REV.), received on 29 June 2016
The Commission contacted the Finnish authorities and asked for some clarifications on their
purchase of 100 Leopard 2A6 tanks from the Dutch government. The Finnish Government
gave information on the procedure, reasons and justification for the purchase. In their reply,
the Finnish authorities pointed out, among other things, that they intended from the beginning
to purchase used Leopard tanks. To do so, they approached various governments (including
the Netherlands) to explore the possibility to purchase such military equipment.
The Commission understands that, following these contacts with various governments aimed
at identifying the best solution to meet their requirements, the Finnish authorities made the
decision to purchase the 100 used Leopard 2A6 tanks from the Dutch government for around
200 million euro. The procurement includes additional equipment (spare parts, dummy
ammunition) and services (personnel training). As public contracts awarded by a government
to another government relating to the supply of military equipment are, in principle, excluded
from the scope of application of Directive 2009/81/EC, the Commission could only
investigate the case further, if there were indications of misapplication of this exclusion, in
particular due to the purpose of circumventing the Directive. However, following the reply of
the Finnish authorities, the Commission does not have any evidence or doubts of such
misapplication.
Conclusion
The Commission cannot help the petitioner. It is not possible to establish any misapplication
of the provisions of Directive 2009/81/EC in the Finnish Government's purchase of
100 Leopard 2A6 tanks from the Dutch government.
Kyllä se näin juuri on.Aikaisemmin on mainittu, että tuo putki takana on "lepuutus asento", eli putki lepää jonkin tuen päällä, eikä ole suuntauskoneiston varassa, jolloin suuntauskoneisto ei kulu putken heiluessa jokaisesta töyssystä. Toiset ovat maininneet muitakin syitä ja ne voivat olla ihan yhtä valideja kuin minunkin.
Pikaisella googlauksella on ainakin meikäläisellä pienehköjä vaikeuksia uskoa että Jürgeniltä voisi ostaa 100 2A6:sta varaosineen jne oheispalveluineen...tai edes varaosia 2A6:een.Onko kukaan törmännyt aiemmin tähän Suomen Leopard-kauppaa koskevaan valitukseen? Millä motiiveilla tämä Jürgen Rahf on tehnyt valituksen, ei kai hän nyt vakavasti kuvittele, että olisi kyennyt jostakin hankkimaan vastaavia vaunuja ja myymään niitä PV:lle?

Pilipalijuttuja. EU:n hankintadirektiivi (ja sen perusteella säädetyillä kansallisilla lait) sisältää poikkeuksen kansallisen turvallisuuden kannalta tärkeän hankinnan osalta. En nyt jaksa hakea säädöstä, mutta tämä siis koskee sotilaallisia hankintoja.
