The former CIA director also pushed back on Ratcliffe's declassification of a heavily redacted CIA memo related to the investigative referral forwarded to the FBI at the time. The memo notes that the Russians allege Clinton's effort to stir up a scandal was "a means of distracting the public from her use of a private email server."
"If, in fact, what the Russians were alleging that Hillary was trying to highlight the reported connections between Trump and the Russians, if that was accurate and a big if, there is nothing at all illegal about that," Brennan said.
"John Ratcliffe and others are trying to portray this as unlawful activity that deserves follow-up investigation by the FBI. No. It was a campaign activity," he added.
Allies of the President have seized on the documents declassified by Ratcliffe, including the release of Brennan's notes and the CIA memo, as evidence the FBI should investigate unfounded claims that Clinton committed crimes during the 2016 campaign.
They have also cited the documents in an attempt to further undermine the intelligence community's unanimous assessment that Russia interfered in 2016 to help Trump ahead of the 2020 election -- claiming, without proof, that Clinton sought to manufacture a scandal to hurt Trump.

Manhattan prosecutors are intensifying their investigation into Donald Trump’s businesses, taking aim at a Westchester County, N.Y., estate that the former president unsuccessfully tried to develop, according to people familiar with the matter.
In recent weeks, according to the people, the Manhattan district attorney’s office has issued new subpoenas and requested recordings of local government meetings related to the Trump Organization’s failed attempt to create a luxury subdivision at Seven Springs, a 213-acre property that the former president bought for $7.5 million in 1995.
Mr. Trump has valued the property at up to $291 million in financial statements that the New York attorney general’s office, which is also investigating Seven Springs, said were given to financial institutions. Inflating assets to help secure loans or other financial benefits can be a state criminal offense, legal experts said.
The scrutiny of Seven Springs is part of a broader criminal probe into Mr. Trump, his company and its officers that also includes financial dealings at properties such as Mr. Trump’s flagship Trump Tower in Manhattan, The Wall Street Journal has previously reported. Outside of New York, prosecutors are also examining a loan for the Trump International Hotel and Tower Chicago, people familiar with the matter said, which CNN reported earlier.
Manhattan District Attorney Cyrus Vance’s office has said in court filings it is investigating possible tax, insurance and bank fraud.

Dominion Voting Systems on Friday filed a $1.6 billion defamation lawsuit against Fox News, arguing the cable news giant falsely claimed in an effort to boost faltering ratings that the voting company had rigged the 2020 election.
It’s the first defamation suit filed against a media outlet by the voting company, which was a target of misleading, false and bizarre claims spread by former President Donald Trump and his allies in the aftermath of Trump’s election loss to Joe Biden. Those claims helped spur on rioters who stormed the U.S. Capitol on Jan. 6 in a violent siege that left five people dead, including a police officer. The siege led to Trump’s historic second impeachment.
Dominion argues that Fox News, which amplified inaccurate assertions that Dominion altered votes, “sold a false story of election fraud in order to serve its own commercial purposes, severely injuring Dominion in the process,” according to a copy of the lawsuit obtained by The Associated Press.
“The truth matters. Lies have consequences,” the lawsuit said. “Fox sold a false story of election fraud in order to serve its own commercial purposes, severely injuring Dominion in the process. If this case does not rise to the level of defamation by a broadcaster, then nothing does.”

Wisconsin’s Democratic Governor Tony Evers has asked a federal judge to order Donald Trump to cover $145,000 in legal fees the state spent to defend against the former Republican president’s unsuccessful effort to overturn its 2020 election results.
In a filing in Milwaukee federal court on Wednesday, Evers’ lawyers said there was “no doubt that Trump and his attorneys brought and litigated this lawsuit in bad faith.”
“Unconscionably, they did so for the purpose of sowing doubt about the legitimacy of the 2020 presidential election, with a goal of disenfranchising nearly 3.3 million Wisconsin voters in order to secure the presidency contrary to majority will,” they wrote.
